TERMS OF SERVICE FOR SCENIC GLIDER FLIGHTS (hereinafter the „Terms”)

of 10 June 2025

INTRODUCTION:

Bisek Aviator Sp. z o.o. with its registered office at ul. Ludwika Solskiego 4/6; 52-416 Wrocław, Poland, VAT ID: 9131630060, REGON: 387441320 offers you the opportunity to „leave the ground” and feel the freedom of being in the sky, by arranging a scenic glider flight with an aerotow launch.

DEFINITIONS:

Service – the organisation and performance of a scenic glider flight, flown by a gliding instructor, with an aerotow launch. The Service may also include the Video experience.

Service Provider – Bisek Aviator Sp. z o.o. with its registered office at ul. Ludwika Solskiego 4/6; 52-416 Wrocław, Poland, KRS no.: 0000867746, VAT ID: 9131630060, REGON no.: 387441320, which provides the Service.

Customer – the entity using the Service provided by the Service Provider, being a natural person, a legal person or an organisational unit without legal personality to which the law grants legal capacity. The Customer may be the Person completing the Form. The Recipient is also deemed to be the Customer when their name is indicated in the Form by the Person completing the Form. Furthermore, the New Customer is also deemed to be a Customer.

Person completing the Form – the person making the payment and receiving the Voucher(s) or paying for the Video experience, indicating in the form the name of the Recipient, and not being the Customer at the same time.

Recipient – the person indicated by the Person completing the Form – in which case the Recipient will be the Customer.

New Customer – a person whose details the Customer has provided to the Service Provider and who thereby becomes entitled to use the Service on the same terms as the Customer.

Voucher – a document entitling the Customer to use the Service. The Voucher entitles the holder to a scenic glider flight lasting 15 or 30 minutes respectively. The purchase price of the Voucher is indicated in the Form.

Video experience – an additional service which may be selected by the Customer or the Person completing the Form, consisting in the Service Provider recording the Customer’s glider flight. The price of the Video experience is indicated in the Form.

Form – the form available on the website, in which the Customer or the Person completing the Form selects: the type of Voucher(s), may select the Video experience, enters their details: name, e-mail, telephone, and selects the Payment method.

Payment method – a payment method offered by the online payment service Przelewy24, which intermediates in transferring payments between the Customer and the Service Provider, namely payment:

1. by card
2. by online transfer or traditional bank transfer
3. via Google Pay
4. via Apple Pay

I. THE SERVICE AND METHOD OF PAYMENT:

1. The Service Provider undertakes to provide the Service to the Customer, and the Customer / Person completing the Form undertakes to pay the Service Provider for the Service provided.
2. In order to use the Service, the Customer or the Person completing the Form shall complete the Form available here, selecting in it:

1. the type of Voucher – for a 15 or 30 minute scenic glider flight respectively, and the number of vouchers
2. the Video experience (optional) – the number of such services
3. their details, i.e.:

• Name and surname
• E-mail
• Telephone
• it is possible to indicate the „Recipient’s details” in the form – their name and surname
• the Payment method

• Crediting the Service Provider’s bank account with the payment amount is tantamount to acceptance of these Terms by the Customer or the Person completing the Form.
• Once the payment has been credited to the Service Provider’s bank account, the Service Provider shall prepare and send the Voucher(s) to the e-mail address indicated by the Customer or the Person completing the Form, based on the details given in the Form. The Voucher(s) shall be sent no later than within 3 business days from the date the payment referred to in the preceding sentence is credited.
• After the Customer or the Person completing the Form receives the Voucher(s), the Customer shall be entitled to use the Service until 31 October of the year in which the Voucher(s) were obtained. In order to use the Service, the Customer shall contact Leszek Wlazło, tel.: +48 603 900 046 in order to agree the date on which the Service Provider will perform the Service.
• If the Customer does not wish to use the Service, they may, no later than 14 days before the expiry of the deadline referred to in paragraph 5 above, provide the Service Provider with the details [name and surname] of a New Customer at the e-mail address: marketing@elitecore.pl or by contacting Leszek Wlazło by phone at +48 603 900 046. The provisions of paragraphs 4 and 5 above apply accordingly.
• Taking into account that, due to their nature, the Services depend on weather conditions, the Service Provider is entitled to set a date for performing the Service other than the one referred to in paragraph 5 above or other than the one indicated by the Customer or the New Customer. The Service Provider’s priority is the safety of the Customer or the New Customer while the Service is performed.

II. Withdrawal from the Terms

1. A Customer who is a consumer or a person referred to in Article 385⁵ of the Act of 23 April 1964 – the Civil Code, may withdraw from the Terms without giving a reason within 14 days of the date on which the Service Provider’s bank account was credited with the Payment amount.
2. To meet the deadline referred to in paragraph 1 above, it is sufficient to send the Service Provider a statement of withdrawal from the Terms before the expiry of that deadline, by e-mail to: marketing@elitecore.pl
3. The right to withdraw from the agreement is not available to the Customer or the Person completing the Form if the Service Provider has performed the Service. The Service Provider hereby informs the Customer or the Person completing the Form that once the Service has been performed, the Customer or the Person completing the Form loses the right to withdraw from the agreement, and the Customer or the Person completing the Form consents to the full performance of the service by the Service Provider before the expiry of the 14-day withdrawal period within the meaning of Article 38(1)(1) of the Act of 30 May 2014 on Consumer Rights.
4. The Person completing the Form or the Customer is not entitled to demand a refund of the full amount paid from the Service Provider if they do not use the Service within 14 days of purchasing the Voucher(s), provided the Service Provider was ready to perform the Service within that period. In such a case the Person completing the Form or the Customer is entitled only to demand a refund of 70% of the amount paid.

III. Complaints:

1. The Customer or the Person completing the Form has the right to submit complaints regarding the performance of the Service to the e-mail address: kontakt@cloud-elite.pl.

2. A properly submitted complaint should contain at least the following information:

a) identification of the Customer or the Person completing the Form (name, surname, e-mail address),

b) the subject of the complaint,

c) the circumstances justifying the complaint.

3. The Service Provider is obliged to respond to a complaint from the Customer or the Person completing the Form within 14 days of receiving it.

4. The Customer / Person completing the Form may withdraw from the agreement using the following form
